If you are using our Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Our Platform

DashAssist provides an AI-powered customer support platform that helps businesses automate and enhance their customer interactions across multiple channels including WhatsApp, Instagram, email, and other communication platforms.

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice for material changes that adversely affect your use of the Service.

Beta Features

We may offer access to beta features or services that are still in development. These are provided “as-is” without warranties, and we may modify or discontinue them at any time.

3. Account Terms

Registration

You must provide accurate, complete, and current information during registration and keep your account information updated.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Account Termination

• You may cancel your account at any time through your account settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the Service will immediately cease

4. Acceptable Use Policy

You retain ownership of content you submit to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content as necessary to provide the Service.

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

6. Payment Terms

Subscription Plans

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are exclusive of taxes unless stated otherwise
• You authorize us to charge your payment method for all fees

Changes to Pricing

We may change our fees with 30 days’ notice. Continued use after the notice period constitutes acceptance of the new fees.

Refunds

• Monthly subscriptions are non-refundable
• Annual subscriptions may be eligible for pro-rated refunds at our discretion
• We offer a 14-day free trial for new users

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Data Ownership

You retain all rights to your customer data. We process your data solely to provide the Service.

Data Security

We implement industry-standard security measures but cannot guarantee absolute security.

8. Disclaimers and Limitations of Liability

Service Availability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

No Warranties

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• The Service will meet your specific requirements
• Results obtained will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASHASSIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold DashAssist harmless from any claims arising from your use of the Service or violation of these Terms.

9. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to bring claims against DashAssist only in your individual capacity and not as part of any class action.

10. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and DashAssist regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Assignment

We may assign or transfer these Terms; you may not assign or transfer these Terms without our written consent.

Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service.
